Judge Orders Maryland Dept. of Human Resources to Cease ...

Silver Spring, MD, August 30, 2012 ?(PR.com)? In a ruling that is startling in its implications, a Montgomery County Circuit Court judge has ordered the Maryland Department of Human Resources (DHR) to refrain from the abusive tactics it has pursued in shutting down a 40-year-old business that serves adolescent children in the Maryland/DC metro area.

In his July 27, 2012 decision granting a preliminary injunction favoring the Koba Institute, Judge Eric M. Johnson ruled:

?[P]ublic interest mandates that this Court issue a preliminary injunction. More specifically, this Court finds that Defendant MDHR?s failure to follow governing regulations are public interest issues that warrant issuing a preliminary injunction.?

By calling this a public interest matter, Judge Johnson has clearly indicated that the harm caused by DHR?s actions is not limited solely to the damage done to Koba. It affects the entire public at large.

Koba Institute, Inc. has operated a group of five residential child care facilities in Anne Arundel, Montgomery and Prince George?s Counties for over 20 years. The facilities are licensed by DHR, and they comprise one of the largest high intensity residential child care programs in the state.

In October 2011, Darlene Ham, the new Interim Executive Director of DHR?s Office of Licensing and Monitoring (OLM), issued a ?Letter of Intent to Revoke? (LIR) Koba?s licenses without giving Koba prior notice. This action violated several sections of the Code of Maryland Regulations (COMAR). DHR also set a moratorium on new referrals to Koba from its county-level agencies ? even though it never actually revoked Koba?s licenses.

On February 27, 2012, Judge Johnson issued a temporary restraining order (TRO) against DHR, finding that Koba had suffered ?irreparable harm? because of:

?Defendant?s unwillingness to issue an explanatory and clarifying letter regarding Plaintiff?s current posture in the administrative proceedings.?

DHR continued its moratorium on new referrals from DHR local agencies, and on May 1, 2012, Ms. Ham sent a letter to 24 social service agencies, including agencies in the District of Columbia, instructing them not to refer residents to Koba?s homes. However, though no new referrals were forthcoming, no agency ? not even DHR?s county-level agencies ? took action to remove the residents already housed in Koba?s homes at any point after the LIR was issued. This speaks to the high regard these agencies have for Koba?s programs.

In reference to DHR?s moratorium on referrals, Judge Johnson found in his July 27 preliminary injunction that:

?Plaintiff is likely to succeed on the merits of its claims that Defendant [DHR] failed to follow governing administrative regulations in the notice, violation and sanctions process employed by MDHR in placing the Koba Institute, Inc. on the ?hot list? by not following regulations pertaining to COMAR 07.05.01.18 and 07.05.01.19, which require that prior to sanctions or a suspension being imposed, Plaintiff must be notified of the violation(s) and given the opportunity to cure the violation.?

In spite of DHR?s actions, Koba has sought an amicable solution to this crisis. In March 2012, Koba sent a letter to Theodore Dallas, secretary of DHR, requesting that DHR officials take part in mediation, retract the department?s intention to revoke Koba?s licenses, follow COMAR, and once again regard Koba as an organization in good standing. These efforts were to no avail.

DHR?s actions have caused significant economic harm, not only to Koba and the 50 members of its staff who have been laid off, but also to those with whom we do business.

Koba continues to fight DHR?s illegal and destructive actions. Virtually every substantive decision made by the Montgomery County Circuit Court, up to and including Judge Johnson?s preliminary injunction, has been in Koba?s favor. Yet, DHR has decided to prolong this fight through judicial procedures that hide behind ?sovereign immunity.?

That is why Judge Johnson, in observing the extent of COMAR violations perpetrated by OLM under DHR?s Social Services Administration, headed by Ms. Carnitra White, held:

?Defendant MDHR?s failure to follow governing regulations are public interest issues that warrant issuing a preliminary injunction.?

Furthermore, in his preliminary injunction, Judge Johnson commented on a prior decision of the Office of Administrative Hearings, which was based on the LIR:

?ORDERED, that Defendant MDHR and/or any of its agents are hereby enjoined from considering the ruling of the administrative hearing.?

Nevertheless, DHR has failed to act in good faith to respect the orders in this and other rulings by the circuit court. Koba has sent a second letter to Secretary Dallas, detailing and documenting the full range of DHR violations and enforcement mistakes. Because of the ?public interest? involved in this case, Koba has also asked the relevant committees of the Maryland Senate and House of Delegates to initiate hearings on this matter brought to their attention by the circuit court.

Mancini targets five signings by transfer deadline

Manchester City manager Roberto Mancini is confident of wrapping up five new signings before Friday night's transfer deadline.

Mancini went into the final hours of the transfer window with Jack Rodwell as his only capture of the summer.

But he is hoping to complete a deal for Benfica's Spain international Javi Garcia, Fiorentina's Serbian centre-back Matija Nastasic, Inter Milan defender Maicon, Swansea winger Scott Sinclair and back up goalkeeper Richard Wright.

The Italian has suggested his frustration that City have struggled to add new faces after winning a first title since 1968.

But he is optimistic about pulling off five late deals.

"Maicon, Garcia, Nastajic: We have another 10, 12 hours to close on these players. We need more time. I am confident," Mancini said.

"I was frustrated as it is difficult to do everything in one week or 10 days, only this reason. Now I think we work very well in the last 10 days, two weeks.

"We need a goalkeeper with experience and Richard Wright is good for us.

"With Scott Sinclair, we are working, we are waiting. I think we have a good chance to close but we need to wait.

"I think that if we do Sinclair is the same position but like Adam (Johnson) but the difference is that Adam runs with the ball at his feet and Sinclair has the ball into space.

"Adam did very well for us, scoring goals, he played and I hope Sinclair can do like Adam or better."

Mancini also expects Netherlands international midfielder Nigel de Jong to tie up a move to AC Milan before the window closes.

The Dutchman, 27, refused the offer of a new contract in the summer and, as the former Hamburg man only has one year remaining on his current deal, City have agreed to let him join the Italian club.

Mancini added: "Nigel has only one year left on his contract and this was the reason. I am sorry because Nigel was an important player for us but if he is happy, I am happy for him.

"I am sure he will do really well in the Italian championship."

City won the title on the final day of last season with a 3-2 victory over Saturday's opponents QPR.

At one stage City were trailing 2-1 and United looked set for a 20th title.

But Mancini said: "No, never. But three or four minutes to the end and you are 2-1 down it is difficult. In the end we deserved it.

"I think we have a very good memory from last season. Tomorrow will be the same, we have a very difficult game. QPR bought more players, I think it will be a tough game."

Mancini is also optimistic about City's chances of progressing to the Champions League knock-out phase despite being drawn in the same group as Real Madrid, Ajax and Dortmund.

Last year, City failed to get out of a group containing Bayern Munich, Napoli and Villarreal even though they picked up 10 points.

Mancini is sure it will be different this time.

He said: "I am confident. You should be lucky in the draw but for a team that plays for the first or second time in Champions League, this can happen."

Mancini expects Sergio Aguero to return after the international break after a knee problem and Gareth Barry is closer to a return from a groin injury but Micah Richards is out for several more weeks with an ankle problem.

Camp Little Red Door helps restore a sense of normalcy for children with cancer

Going away to summer camp is a tradition for many children, but what if you are a child who has cancer? Thanks to Camp Little Red Door, that can still happen.

Fox 59 spent the day at Bradford Woods in Martinsville, where children with cancer are getting a reprieve from their normal day-to-day challenges.

?I didn't know what to think, I just knew times were going to be tough,? said Ciera Little as she thought back on when she was first diagnosed with bone cancer at just 8 years old.

Times were tough, but now, as a teenager and a cancer survivor, she has a support group full of children and teens who know what it's like.


?I say that you can get through it since I did when I was 5 years old and since I got through it, you can,? said Ryan Lopez, also a cancer survivor.

?You share what each other is going through, you share goals and you just share an experience that nobody else really understands,? Little said.

Camp Little Red Door is also about restoring a sense of normalcy.

?You can do anything and everything that you want and not have to worry about the medical aspect of it,? said Anna Buchheit.

Buchheit initially went to camp along with her younger sister who battled childhood cancer. She returned year after year and is now a camp counselor.

Just like any other camp, they go hiking, fishing and do activities like archery and basketball.? The idea is to just let them have fun and be kids.

Buchheit said it is important because she knows they've been forced to grow up too quickly as they dealt with very grown-up issues.

?We understand different emotions, different experiences. We take life differently than others might,? Buchheit said.

?It has been really sad and hard for me to know that some of my friends have died from cancer,? Lopez said.

The campers also know each year, they have camp to look forward to and they invite other children who have been through cancer treatment to join them.

?It?s just like a big family. No matter what, just come for your first year because the staff makes you feel incredible,? Little said.

The camp is held for one week each summer and there is a full medical staff on site.

The cost for each camper is $1,250, but Little Red Door fundraises and gets donations so each camper only has to pay $25 for the week. Even that amount can be waived if finances are a concern. Each camper is also allowed to bring a sibling or friend with them to camp each year.

The Forum will be organised under the umbrella of AXA Matrix Risk Consultants, an AXA Group entity for marketing and delivery of both bundled and unbundled risk consulting products and services worldwide.

The first-of-its-kind forum, to be held at AXA Gulf offices in Business Bay on September 4, 2012, will involve nearly 30 top-level officials representing leading insurance risk engineers in the region. This common platform looks to educate the participants on the various risk management and prevention solutions.

It will involve general discussion as also an overview of fire engineering; fire testing, certification, implication and experience in design of fire safety. The forum will also focus on an insurance survey report of high rise buildings and analyze the various risk prevention strategies adopted.

Hermann Frankfurth of AXA Matrix Risk Consultants, said: "In a competitive environment, increasing emphasis is placed on the management of risks to a business and identifying these risks can be a complex process. Hence, we thought of conceptualizing a forum where top risk engineers from leading insurance companies and brokers debate the requirements and strategies to effectively mitigate the risks and help prevent them."

He added: "The industry has to face larger and technologically more complex risks and we all need to understand and appreciate the impact of changes in technology and coverage. An unusual arrangement is coming soon to Atlantic City in which the Mohegan Indians will buy a piece of Resorts Casino Hotel in Atlantic City and run its day-to-day affairs.

The deal centers on a $35 million expansion that will bring a Margaritaville restaurant to the casino, splashing palm trees and parrots across its facade. But the casino?s existing Roaring ?20s theme, adopted to take advantage of interest in the hit HBO series ?Boardwalk Empire? about Prohibition-era Atlantic City, is staying, too.

The idea is to bring new excitement (and new customers with their new money) to a casino that has struggled since nearly having to close two years ago. The alliance with the Mohegans and their well-established casinos in Connecticut and Pennsylvania should give a big boost to Resorts, which was the first casino in the United States to open outside Nevada.

?We are really excited about this,? said Mitchell Etess, CEO of the Mohegan Tribal Gaming Authority. ?It?s a win-win for everyone involved.?

The arrangement must be approved by New Jersey casino regulators. A vote has yet to be scheduled, but one could come next month.

It became necessary following the sudden death of Resorts co-owner Dennis Gomes in February. A veteran of the casino industry, and the inspiration for the hit movie ?Casino,? Gomes had been working to turn Resorts around from years of losses under previous ownership to bigger, newer competitors in Atlantic City and in surrounding states.

Following Gomes? death, Resorts owner Morris Bailey began discussing a marketing alliance with the Mohegans, but talks progressed quickly into a deal to have the tribe?s management arm, Mohegan Gaming Advisors, provide the experience and know-how that was missing without Gomes at the helm.

Etess is particularly proud that the Mohegans are being called on to run an established commercial casino.

?What it shows is how the gaming industry has changed, and how tribal gaming has grown,? he said. ?It used to be that commercial casino companies would help tribes build and run casinos. Now it?s the other way around; things have progressed to the point where commercial casinos want us to come in and help them.?

Etess said he hopes to have the Margaritaville restaurant running by Memorial Day weekend. It will occupy the Boardwalk frontage of the casino where two smaller restaurants now sit. Across the Boardwalk, a Landshark Bar & Grill will be built on the sand, along with bocce ball and volleyball courts.

?Margaritaville is a big draw; it?s the highest grossing restaurant in Las Vegas, and the one we have (in Connecticut) does very well ? and neither one of them is anywhere near a beach,? Etess said. ?The potential for this kind of attraction literally right on the beach is just fantastic.?

Margaritaville, named after Jimmy Buffett?s most famous song, nearly came to Atlantic City four years ago when a New York developer inked a deal to buy what was then the Trump Marina Hotel Casino and re-brand it. But that deal fell apart, and the casino was bought by the owners of the Golden Nugget.

Aside from Margaritaville, the biggest part of the deal is the affiliation of Resorts with Mohegan Sun properties in Connecticut and Pennsylvania; players will be able to use comps and credits at any of the three casinos interchangeably. That?s exactly what Carol Gleason of Saddle Brook, N.J., plans to do.

?We go to Foxwoods now, but I?ll have to try Mohegan Sun,? she said during a morning of craps and slot machine gambling at Resorts. ?That sounds nice.?

Steve Norton, an Indiana casino consultant who was vice president of Resorts when it opened in 1978, says there?s a lot to like about the deal, citing the group?s casino experience.

?Mohegan, which was recently refinanced, brings a stronger balance sheet to the partnership, which is paramount in today?s Atlantic City,? he said. ?The tribe and its excellent player base in New York and north Jersey can be shared by Resorts.?

Nonetheless, Resorts still has problems, Norton added.

?The picture is bleaker over the next six to nine months, starting after Labor Day,? he said. ?Resorts has positive impacts coming from the addition of Jimmy Buffett?s Margaritaville; but it remains to be seen if this type expansion will put customers in beds those 200 mid-week nights from September thru next June.?

Gomes? son Aaron, Resorts vice president, has been helping to run the business since his father?s death, and Resorts has inched back toward profitability. It posted a gross operating profit of $199,000 in the second quarter of this year compared with a $5.9 million quarterly loss a year ago. Etess has asked the younger Gomes to stay on under the new regime, but he has yet to decide whether to do so.

Etess said Resorts will keep its Roaring ?20s theme in the non-Margaritaville portions of the property. The hotel, which was built in the 1920s, has marble and wood that would be costly to replace, but that still looks elegant, he said. Staying, too, are the flapper-style costumes that female beverage servers wear (and that have generated two lawsuits from older workers who claim they were fired after being judged insufficiently sexy in them).

Etess said the Mohegans have wanted to enter the Atlantic City market for years, but did not want to spend $1 billion or more to build a casino from scratch. This deal provides an affordable entry to the market, currently ranked third in the U.S. after Nevada and Pennsylvania.

He also said the tribe has no plans to eventually buy Resorts outright. But if it does a good job running it and restoring it to profitability, that could open the doors to other management jobs at non-Indian casinos.

?It?s a great opportunity to show what we can do,? Etess said. ?We know we can do a great job.?

Sporting KC loses Bunbury for season to hurt knee

KANSAS CITY, Kan. (AP) - Sporting Kansas City forward Teal Bunbury will miss the rest of the season after tearing ligaments in his left knee during a draw with the New York Red Bulls.

The injury occurred Sunday night as Bunbury was leaping in the air to set up Kei Kamara for a goal. Bunbury remained in the game for several minutes but was eventually substituted out.

The extent of the injury was revealed Monday. Surgery is scheduled for Friday.

Bunbury has five goals and one assist in 22 regular season games after leading Sporting KC with 11 goals last season. He has 21 goals and six assists in three MLS seasons.

Sporting KC (14-7-5) leads the Eastern Conference by two points over New York.

In addition to his work as debate guru for the Romney campaign, Portman will continue his work as Romney's Ohio state chairman.

Gomez has the most amazing green eyes that will grab your attention right away. Then he will win you over with his personality and sweet purr.

Sparrow is such a sweet girl. She only wants a home to give her love and some good food. She is a pretty tabby with white trim and already spayed.

The U.N. nuclear agency is forming a special Iran team, drawing together sleuths in weapons technology, intelligence analysis, radiation and other fields of expertise as it seeks to add muscle to a probe of suspicions that Tehran worked secretly on atomic arms, diplomats tell The Associated Press.

Creating a unit focused on only one country is an unusual move for the International Atomic Energy Agency, reflecting the priority the U.N. nuclear watchdog is attaching to Iran amid fears that it is moving closer to the ability to make nuclear weapons. It also indicates frustration by top agency officials over Iran's refusal to cooperate with IAEA experts who are trying to follow up on suspicions that Tehran was ? or is ? secretly working on an arms program.

Iran says such allegations are based on evidence fabricated by the United States and Israel and insists its nuclear program is meant only for making reactor fuel, medical isotopes and peaceful research. But it refuses to give up uranium enrichment, which can produce both reactor fuel and the core of nuclear warheads, despite offers of fuel from abroad. And its stonewalling of the IAEA probe has increased concerns that it has something to hide.

The agency's move comes at a crucial time. With both the agency and international diplomatic efforts stalemated in attempts to engage the Islamic Republic on its nuclear program, fears are growing that tensions could spill over into armed conflict.

Israeli leaders have been loudly expressing impatience over Western diplomatic and economic moves to deter Iran and increasingly talk of attacking its nuclear facilities, though some analysts believe the saber-rattling is a bluff to increase pressure on Tehran. Iranian leaders have rejected Israel's warnings, threatening punishing retaliation.

The four diplomats, who demanded anonymity because they were not authorized to discuss the restructuring plans, spoke ahead of a renewed attempt Friday by the agency to breach Iranian resistance to its requests for access to sites, documents and people linked to the suspected secret weapons-related work.

One of diplomats likened the restructuring plan to the agency's Iraq "Action Team" ? the squad of experts who uncovered components of Saddam Hussein's fledgling nuclear-weapons program in the 1990s.

That unit, however, had broad on-the-ground access under U.N-mandated inspections. That's lacking in the case of Iran, which allows agency inspectors access only to its known nuclear activities and has for years blocked its attempts to probe alleged evidence of secret nuclear weapons research and development.

Asked for reaction on the IAEA plans, Ali Asghar Soltanieh, Iran's envoy to the IAEA, said: "I have not heard of such a thing, and I cannot comment." IAEA spokeswoman Gill Tudor said the agency had no immediate comment.

Danny Danon, deputy speaker of the Israeli Knesset and a member of Prime Minister Benjamin Netanyahu's Likud party, told the AP in a phone interview Thursday that Israel was "preparing for all scenarios." He also was dismissive of the agency's new Iran squad.

"We are getting close to the point where the window of opportunity will be closed to us, and that's why you hear all those voices," he said when asked about the war rhetoric. "We have seen too many teams, too many summits, too much talk. It is about time to take action."

Instead of focusing only one country, agency experts up to now have been tasked with following dozens of nations as they look for signs indicating secret attempts to make nuclear weapons.

Some IAEA officials feel that means that they often spend an inordinate amount of time monitoring countries that are unlikely to engage in such activities ? Western European nations for instance ? meaning that not enough attention is paid to potential proliferators.

Under the planned reorganization, said one of the diplomats, a "dedicated team" of about 20 experts will be drawn from the main IAEA pool to focus solely on the agency's Iran investigation.

The United States and other nations on the IAEA's 35-nation board that are suspicious of Tehran's nuclear activity are expected to welcome the move.

But two of the diplomats spoke of opposition by board member Russia, which has supported diplomatic efforts to nudge Iran toward a nuclear compromise while strongly opposing harsh sanctions as a means of achieving that goal.

They said senior agency officials had met recently with ranking Russian representatives in efforts to dispel Moscow's fears that the reorganization would place too much weight on intelligence gathering ? an agency function viewed with suspicion by the Russians.

At the Friday meeting, senior IAEA officials are expected to press Iranian representatives for access to a site at the Parchin military complex southeast of Tehran that they suspect was used for nuclear-weapons-linked experiments.

Tehran says a visit is possible only after extensive planning and a detailed outline of procedures. IAEA officials in turn privately describe that caveat as a stalling tactic, citing satellite photos apparently showing a major clean-up effort at the site.

Iran has repeatedly turned down IAEA requests for access and agency chief Yukiya Amano was downbeat ahead of Friday's talks.

"I cannot say that I am optimistic about the outcome of the coming meeting," he told reporters in Helsinki, Finland, on Wednesday. "I cannot say when we can reach agreement."

Wallee iPad 3 Case and Hand Strap


The Wallee iPad 3 Case ($39.95 AUD/$42 USD approx.) ?is the foundational piece for a modular system of accessories designed for the New Apple iPad?. Wallee is based out of Australia, but offers free global shipping, and serves up a number of useful add-on accessories that work seamlessly with the Wallee iPad case. We tested the Wallee case with the optional Hand Strap ($19.95 AUD/approx.?$21?USD). The case itself is a little pricey for a plastic shell, and the cost of accessories can quickly add up, but if you want an easy-to-use universal system for mounting and using your iPad in a variety of ways, the Wallee system is a nice, clean solution.

Wallee Hand Strap

The Wallee case is a thin and light piece of rubberized plastic, which snaps easily onto the edges of the New iPad. There are appropriate cutouts for all ports and buttons, with a signature Wallee cross in the center of the back panel, exposing the Apple icon. The case is flush with the iPad at the edges, but slightly raised towards the center, under the cross, to accommodate various Wallee accessories. The Hand Strap features a simple felt velcro strap attached to a solid metal base with a plastic cross on the bottom. To attach accessories, simply line up the crosses, press them together, and twist into place.?

It lets you easily hold the iPad without fear of dropping it and reduces hand strain from holding the iPad with just one hand. It's a similar concept to the Octa Vacuum Dock + WhaleTail?and the Speck Handyshell?case.

The real beauty of the Wallee system is its vast array of easily swappable accessories and mounts. There are simple wall mount discs (approx.?$10.50 USD each), a high-end desk or table stand called the Pivot (approx.?$63 USD), a VESA adapter (approx. $16), and even car headrest mounts (approx?$42 USD). Swapping between accessories is as easy as a simple twist and pull. When you're not using an add on, the Wallee case is thin, light, and hardly noticeable, but it also only provides minimal protection for the back of your iPad and none for the glass screen. I should note that with the Hand Strap, the iPad didn't feel completely secure, and spinning it to use in a different orientation occasionally caused the strap to pop off. For the mounts and stands, however, this should not be a problem.

Rather than buying separate cases, stands, mounts, and other accessories, each requiring removal when you want to swap, the Wallee system allows for hassle free accessory transitions. The company also makes a case for the Samsung Galaxy Tab 10.1?, which uses the same add-ons. All told, the system is easy to use, and worth a look if you want a unified set of accessories for your iPad.?
